We will create a section 8 notice in accordance with the Housing Act 2004 for your tenant.
The Section 8 notice is a "Fault" eviction notice and is generally used for rent arrears which if proven will guarantee a possession order if the rent is 2 months overdue at the time of service and court hearing.
This notice can be used in many circumstances and we always recommend getting legal advice which we don't provide. However issuing this notice lets your tenants know that action needs to be taken.
In cases where the Local Authority may get involved it is essential that this notice is compliant with the Housing Act 2004 because they have a legal duty under the Homeless Reduction Act 2017 to work with the landlord and tenant to prevent Homelessness.
This notice can be used where a Section 21 notice can't be used because there are issues around deposit protection and prescribed information.
The Section 8 Notice has 8 Mandatory Grounds which if proven guarantees a possession order and 9 discretionary grounds which the judge can deny, delay or grant possession to the landlord.
